It's trying to tell you to use the raw image files directly, not convert them first using the raw converter (I think). If you want to go through ACR first, import the images at 16 bits per channel (then if that warning still comes up, you can safely ignore it).

thats doubly confusing then because I opened the files on disk, not as already open files
I couldn't repeat that, the Merge to HDR dialog accepted my cr2 files without a hickup. One of them had an xmp sidecar (which I didn't select of course).

Ps had been hanging a lot before when I had been trying to select files

No, the changes are written as calculation parameters into an xmp sidecar file.
