Yes, there is no longer any cross browser way to copy data to the clipboard which is what the share dialog needs to do. Smugmug is using a flash applet to accomplish the copying to the clipboard.

It can be done with javascript, but it cannot be done reliably. The main issue is that there is no standard javascript API that can do this. So, often the solutions are browser+platform dependent. The main side effect of this is that the functionality is prone to breakdown with browser upgrades (and this has happened in the past, given so many browser sources around)
Flash just gives a easier way of doing this as the only thing to worry about then is a flash player upgrade, which is likely to be more consistent given that it comes from a single source
