Copyright or Trademarked name

Hi-

This is my first post here. I hope it's in the right place...I'm trying to start a little photography business on the side- starting out with some naturey stuff and portraits of my friends' kids, that kind of stuff. I have a name that I want to use (Brilliant Moments Photography) and have registered the domain (which I know means nothing). When I first chose this name (nearly a year ago) I found no traces of it being used by anyone else. Now some MySpacer has commented that I'm using his "Copyrighted" name, which if I understand correctly, you can't copyright a name. Is trademarking the way to go to protect the name I want to use?

Any advice/info is greatly appreciated.

    You are correct. You cannot copyright a business name. See 2nd passage

    A simple Trademark search shows nothing registered under that name.

    I would go ahead and trademark it, and force them to stop using the term. :D Of course I can be spiteful
