I don't know i should feel good or bad :scratch

WWF for wildlife purchased images from me to use in marketing brochures only for 3 months. Today i received "Catalog" they printed for greeting cards for 2009-2010. And my photos are listed in them as item designs which their clients can order from WWF as greeting cards.

The project manager mentioned me they will be only for brouchers not for greeting cards. Because i gave him higher rate for commercial greeting cards.

I asked for clarification and they started to tell me about economic conditions, their cause, rate of other designs submitted by other artists. they told me, they will give me business in future and send me "WWF Mug with panda on it" :huh. And they attributed whole mess created due to communication GAP. Though one thing was very clear that images are not for greeting cards !

It seems like exploitation ! now what should i do? use WWF in my portfolio and feel proud. Or speak loud against this practice of WWF.

Don't feel bad about chasing him, I've come across this sort before. This manager obviously has his bargaining skills down with the spiel about "economic conditions, their cause" etc. And probably gets a good bonus because of how hard he pushes. It's also bound to be his standard operating procedure to push the limits of the licenses and plead ignorance.

If I were you I'd bill them 5x your initially quoted rate for a retrospective licence covering the cards. Otherwise clearly state that this is a breach of your copyright and you'll be seeking damages and that that they destroy the infringing cards, Catalogues and all other materials that list them for sale.

Also write to someone higher up then this guy, his managers will realize how much damage to their reputation a copyright case against them will cause.

    Awais:

Do you have a written agreement stipulating the limits of use for the images?

I sent them signed quotation + it mentioned photos should be used only on brocuhers for 3 months only. They will send me a cheque against that quotation.
Otherwise there is nothing in written, nor they have any contract signed by me granting them use of photos.
