A couple of questions

I was asked to do some photography at a skate park, which I am really excited about...and this would be really sweet for the kids, since they would love to have their photos taken..
the questions I have are..

Releases...
Do I need a release to take photos of kids when they are not going to be purchased by the public.... all the photos that I will be taken will be uploaded here and put into a password protected gallery, for the parents to buy prints or personal use downloads. But some photos will be in my viewing gallery which can't be purchased. The viewing gallery is like my reference photography.

Short answer is no, you do not need to obtain releases in the situation you have described.

One question for you. You said you were asked to do some photography at the skate park? Who asked you and what was there reasoning? If they want the pictures to promote their park, then yes you would need the release. If the kids are under 18, you would need their parents to sign the release. Even if the skate park has on their walls that by entering the park, they are agreeing to allow their photo to be taken, it still can't be used for promotional purposes by the park without a signed release.

If you are shooting on spec with the sole intention of posting the pictures for the parents to purchase at a later date, then no you don't need a release. However I would suggest you listen to the parents. If they are there and don't want their kids picture taken, be polite and respect their wishes. That sort of thing can get you kicked out in a hurry.

I guess someone else hit the nail on the head though when they said the short answer is no. He's right, if you are shooting on spec and selling only to the parents, you don't need a release. If you are shooting for pormotional purposes of the skate park owners, then yes you will need a release.

sorry, i didn't get to this earlier.....
The lady never called me back.. so I assume it wasn't going to happen..
and it just ended up being so much of a hassle and complications, but there might be another time.

When you need a release:

-To sell prints: No
-To sell to a newspaper or magazine: No
-To sell to a newspaper, magazine or other publication for an advertisement: Yes
-To sell for stock: Yes
-To include in your physical portfolio: No
-To put on your blog, website, Twitter feed, etc: No
-To put in an advertisement for your business: Yes

That being said, unless it's very inconvenient to do so, always get a release when possible. You never know when or how you might want to use an image, and having a model release gives you that freedom without having to somehow find the subject and ask their permission.

just a reminder - when you do get a release, you need parent/guardian's signature for a minor. A 10 year old boy at a skate park cannot sign a model release.
