well after years of working on freezing the action as well as panning I think this challenge is unfair [my lawyer will be giving you a call ]
but how about if I tell you that in this shot the sky is really a blurrr will, that fly [pun intended] :scratch

    Wow, smoothest panning I've ever seen! Those birds are crisp, and the b/g is so blurred you can't make out any detail... A winner for sure! :Drolleyes1.gif

    Jeff make sure your lawyer reads this:

    Photography may be found to be unfair, and hence legally unenforceable. For guidance on this, we refer to the Unfair Photography Theme Terms Act 1997. In a nutshell, this piece of legislation protects Photographers who enter into legally binding agreements with Theme moderators where the contract is biased in favor of the Theme. Unfair clauses are those which try to exclude any of the following:
    • liability for negligence in the event of a photographer failing to use said camera to the best of his/her ability.
    • liability for breach of theme. This includes situations in which the photographer did not carry out their contractual obligations (the photo was not as described or the composition not dynamic)
    • Indemnity clauses are those which protect a moderator from legal action in the event of professional photographer negligence.
    • Photography guarantees designed to protect the photographer in case of damage or defect resulting from inability to read signs.
    • Statutory rights with regard to manipulation and Supply of EXIF legislation.
    • Misrepresentation in the form of false or inaccurate pixels.

    but on a side note, anyone that knows anything about Bird Photography knows this is panning.
