Question on Nudes

I am not clear on the site regulations on this. Are we allowed nudes in galleries? To sell nude prints?

See the Smugmug terms of use here: http://www.smugmug.com/aboutus/terms/. I'd suggest you read 13a.

I have already read that along with the entire page. That is still open to interpretation. Playboy style nudes as paintings, sculptures and photographs are seen in museums all over. I have customers for this type of nudes and wanting to know specifically if those are ok. :) They are not sexually suggestive.

Then you should probably contact the Smugmug helpdesk and get an "official" answer from smugmug directly.

Yes, as I have seen a LOT of museum material I consider pornographic but is in museums. Like Mapplethorpe's works. lol

From what I can gather, sexually suggestive is much, much more acceptable than a nipple. Back asswards if you ask me. :cry

Laughing.gif. But the TOS states that it can be what is allowed in museums.

I asked on a specific gallery I found on Zenfoilo and this was the answer:

If you dare, click the link to find ordinary, unsexual, undressed people. mwink.gif

I wouldn't post those on my OWN hosted site lol. So looks like the key was a PUBLIC gallery. Some I had for sale could be in a password protected album to be viewed only by those wanting to purchase and order prints

No, it's made clear later in the thread that it doesn't matter if there's a password or the gallery is unlisted.

I find that a bit sad. I reject the idea that nudity is harmful for anyone to see and I think a disclaimer by the link to the gallery is plenty. Nudity isn't ugly or shameful, it's not even sexual. It's people with no clothes on!

Andy, I already had. And was informed with this:

Sebastian Hosche [SmugMug Hero], Jan-18 04:01 am (MST):
    Hi Doug,

Thank you for contacting SmugMug. That should be fine if you keep these nudes in unlisted or password protected galleries that aren't publicly accessible.

Let us know if you have any questions.

    All the best,
    Sebastian

So my example from that thread is now OK in a password protected or unlisted gallery?

Please email the help desk with specifics and we will be happy to take a look for you.

The general rule of thumb is that there are no nude photos allowed in public galleries. Nudes that you might find in a museum may be in password protected and unlisted galleries. Photorank, hello world, and hello SmugMug must also be turned off in the gallery settings.

    Hopefully this clears things up!
