Is there a way on smugMug to have a person agree to a set of terms before then can buy or download a photo?

When selling Digital Downloads you can choose to offer either the Personal or Commercial license. Your clients agree to that license when purchasing the downloads.

You can also add a note in a Gallery Description or footer of your site that any purchase made on your site acknowledges agreement to terms that you can mention. You'll should also confer with a legal professional to make sure the terms you set are legal in your area.
