Mascot question: We can't pick our favorite due to trademark

Our institution is looking for a new mascot but we have some that are removing some of the top vote getters that the students picked.

Some favorites were removed because the administration is claiming that the mascots that were picked by students are trademarked so they are only allowing mascots that are not trademarked.

This doesn't seem right. Some of the students picked Cavalry, Vipers, Toros.

We plan on creating original artwork, etc. but really? We can't pick a Cavalry because it's trademarked?

Does being trademarked automatically make it impossible to pick those mentioned or can the institution ask for permission to use the word "Cavalry".

With thousands of students choosing, is this something that can be done?

    can you use a word for which trademark is already assigned?

    No! Yes! Maybe!

    trademark is a complicated area of law with many various layers of definition in branding, usage etc etc.

    the very best way to understand your options would be to pull the original trademark filings on the contested words. this is tiresome work and the documents are littered in legalese that would require an attorney's learned evaluation.

    I venture a guess your school administration is not interested in the cost and bother involved so they are choosing the path of least resistance.
