Street photography Question for all (Andy especially)

Ok in Andys tutorial on street photography at the bottom in the comments someone asks-

"I was wondering, in shots like the last one where the lack of a pose is essential, how do you approach the subjects? I mean if you walked up to those two people and told them to "keep talking while i take your picture please" surely they wouldn't have kept talking the way they did when you found them. So do you ask if its okay to use the picture after you've already taken it?"

There wasnt an answer in the tutorial and I'd be interested in getting every ones opinions.

    This has been in my dock waiting to be answered. Sorry for the late reply!

    I shoot first, and then tell them "wow you look great!" or something like that. I give them my card, tell them they can contact me if they wish. Sometimes it's as little as a wink of any eye, others it's a minute of talk, sometimes it's hours :D

    If I have think I'll be wanting commercial use rights, I'll get a model release.
