I would go for the 1st one: really creepy looking tree with the foggy atmosphere. It's like a octopus reaching out.
The 2nd is too dull (would need more 'pop' in my eyes) and the street is a bit distracting.
I agree, the first tree is beautifully creepy. The nice thing about the second one, though, is the blue color, which gives me more of a predominant color feel. I'm not sure if I'm making too much of that though.
what's that you say? surely cropping is legal. isn't it? isn't IT?!
afterall, you can crop in programs other than PS
Heck, I could crop in my P&S digicam.

I definitely like the composition of the first photo and the mysterious lighting. Just the kind of shot I'd print and frame of the wall
To be honest, the second shot is just more of a snap shot to me. Kind of like the shutter was accidently tripped. Doesn't even hold a candle to your first shot!
Oh the first one made me hold my breath, like when you're watching a scary movie and you're looking through the eyes of the protagonist and you're expecting to be grabbed by something awful.....this one is truly nice. I love the diffused lighting and it nicely compliments the gnarling of the branches. Very very nice.

only basic editing is allowed. this includes minor adjustments in color, contrast, exposure, sharpness. black and white conversion is allowed (including toning for same). that's it - no cloning, filters, special effects, etc.

I really like the first one myself also, didn't think it would come out as well as it did.
