Nudes or partial ok if password used?

I recently saw the long post about artistic nudity and was unsure. I took some pictures at Mardi Gras but did not post any with any nudity. I put a password on the gallery anyway since I was sharing with friends. Since this isn't public, can I post those pics as long as the password is on the gallery? I just wanted a clarification. Thanks

    When I first started my account I had a pic as a test pic that was topless and protected and i got a warning on it... so i would thing the ?er would be no. lol.. but ask the higher ones :).

    :) thank you richard... I need to fix that in the bio! the 49er pics i'll pull... I had a few forums started on that subject and the thing about tiger woods was brought up... I was not charging for them and after that post i added the charge to them. What you think on the logo? should i change? been thinking of a few new logos.. lol

    hmm.. i stuck lowest vs recumended because the sixe i actually recumend is the size above that... Should I change it to that figure? I want all feed back so If I ever do sell a print on here maybe it will help me sell one.. lol.. I can get them sold on ebay just nothing here but then It says i have over 700hits... any ideas?

    Well thanks for hijacking this thread. I hoped someone who works for smugmug would reply to my original question.

    I pm'd someone and got an answer. I understand that sometimes replies go off topic eventually its just that on this one it happened right away, and didn't have any info yet. I saw several replies and after reading all them, was like wondering if I was reading the right thread. I didn't mean to come across rude, just initial reaction.

    The answer is....there is no provision in our terms for relaxing the no nudity requirement if a password is used.

    We have experimented with it and I know of at least one user who has explicit permission from us to continue but I have to say that as a practical issue, most of the experiments have resulted in a black eye for us and some serious rants from offended customers.

    The customer I gave permission to is a professional woman photographer who photographs women in lingerie, presumably for their significant others.

    The ones that have failed spectacularly and repeatedly are ones where we granted permission provided the gallery titles were not R or X-rated, passwords were used, etc.

    Somehow passwords got fumbled or placed in bios or gallery titles. We had to engage furious subscribers in never-ending dialogue about why we thought gallery titles like "Ease into my hot" — oh, never mind, I can't think of a single way to describe what came next — really were R and X-rated, that using smugmug to solicit prostitution wasn't what our other subscribers with children loved about our brand, etc.

    The anger with which both sides spoke to our help desk people made it clear to us that granting permission to have nudity in the galleries was simply untenable.

    I wish we had a better answer for you.

    Thanks for the clarification, but there's one option left:
    What about non-public-galleries or sharegroups? These are not accessable/searchable for users without a correct link and therefore can't offend someone by accident.

    Just asking in case I'll have some nudity pictures and want to put them in my private backup-galleries.

    Sure sounds like it created a lot of trouble for you. I can understand why you want to be rid of it. Not a problem for me - the next nude I shoot will be my first. But i was curious. Thanks for the answer.

    I think it's a good idea not to allow any...that way you will be fair across the board.

    Just an idea if we help smugmug staff develop an guideline for what you must do to protect young eyes from nude images. Just a few ideas, in private gallery or password protected and password not in gallery description, etc.

    well to speack from my self... I hade a topless model in a private folder password protected.. just to test the upload for galleries as i was new and it was a first attemp to upload... less then 12 hours tos contacted me and told me i had to pull it.

    Wow, I seriously doubt those jive with smugmug's TOS. I think smugmug needs to have people scanning galleries periodically or something.

    We'd have to charge *a lot* more than $30-100 / year if we had to look at every photo.

    There are 16,000,000 of them, and many tens of thousands of new ones get added each day. That's a lot of man-hours.

    It'd be like insisting the phone company listen to every phone call to make sure nothing illegal was going on.

    lol.. its more like the computer listens for special words then gets a human to listen in... but the main point of the thread is it's still not ok behind password protected private galleries right?

    Dang if smugmug made a program that can rate a photo by the content they would make millions!! lol... the porn sites can reject not xx enough and the kids site rejecting for to much showing!!
