Editorial Use License Downloads

I provide my images as a photo service to print publications and web services and currently have to process them manually, slowing down the process. I would like to be able to allow digital downloads and see that the hook is there in PRO. I see SM Pro has the "Personal Use Licensed Downloads" and "Commercially Licensed Digital Downloads" license as an option. For photo services, these aren't worded good enough. What would be needed would be a 3rd option offered by SM labeled "Editorial and Non-Commercial Use Only" license. The "Personal" license is close to being worded sufficiently, but for the purpose of promoters, publicists and bands, there needs to be a specific "Editorial and Non-commercial Use Only" license changing the word "personal" to "editorial" in the body should be sufficient.

    Add that you should be able to write a custom license for commercial use where you can provide dfferent types of rights.

    If the photographer is really pro they probalby need more than just a standardized contract.

    I would like to add my vote for this option. Most of the images that I offer at my site are shots that I have taken of people in poverty in developing nations around the world. With issues of language barriers, illiteracy and such, it is virtually impossible to obtain traditional model releases for these images. I really need the "editorial use" license agreement option for my site. It seems like it should be an easy addition ....

    Hi Andy, I know i am a pest, but here goes anyway. This is VERY important... Rather than just saying "no, sorry", Maybe you can explain why this is not easy for SM to incorporate such an addition/mod. From the outside, it seems adding to a drop box selection and modifyling some verbaige would be a relativley easy mod to something that already exists in your system. Again this is VERY imprtant to me and others...

    This is the way your commercial license reads verbatum:


    License For Commercial Use

    What you can do: Photographer grants you a perpetual, non-exclusive, non-transferable, worldwide license to use this image for permitted commercial purposes, defined as:
    • advertising, promotion, brochures, packaging
    • as part of a commercial website for promotional purposes (maximum 800x600pixels) use
    • prints, posters, flyers, tearsheets for promotional purposes (not for resale)
    • prints, posters, or other commercial display of image

    Any updates on this? This is also very important to me as I sell mostly sports (cycling) photos and it's impossible to get a release to be able to offer the commercial license.

    It may not be too hard to add a high capacity text box at the end of the standard licenses where the photographer can type in additional terms that he/she may want for a specific situation. This would provide great flexibility plus the photographers can't complain that SM's licenses are inadequate.

    I'll BUMP this thread again. Its still real important to me, but Andy stopped replying to my replies... Thanks for offiering your idea. Anything would help..

    Yes.. I would like to have that option of Editorial Downloads.. I don't know what has to be done on the SmugMug side.. but think about it.. Stock photography sites don't charge for a yearly membership, where you can upload editorial photos. We pay here a yearly membership, so this will benefit not only us as a pro sales member here at Smugmug but everyone in whole.

    It has been a while since I have checked into this. But now that I am thinking of marketing stock video, it comes up again. I just read through the commercial license again, and it doesn't work for my purposes, as most of my video has been shot in developing countries, where with language barriers and illiteracy, it is almost impossible to get model releases. Without model releases, I cant work with the commercial license the way it is worded. Is there any reason why we cannot either reword the license or have someone at SM develop a good "editorial Use" license?

    I'm amazed this thread has been going on for 6 years! I'm another photographer who needs to be able to use a different license to that provided by SmugMug. I sell digital files to musicians for use on their websites. They need to be able to use images as downloads on their sites, for use in press packs.

    Come on SmugMug - surely this would be simple to resolve by making the license link editable, so photographers could link to their own license if necessary?

    Still no solution since 2007 - coming up on 6 year anniversary of request.
    And this was added to smugmug feedback in 2009...
