Model Waiver

So I have my first model shoot coming up and I'm a little curious about waivers. Do I need one for the model? I figured I would allow shared rights to the photos so she can use them for whatever as well.

I'm shooting them for a buddies screen printing business so I suppose I'll need a waiver for him too. Is there a common template for this? Should I custom write something? What should I include? I'm new to this whole thing so any help is greatly appreciated.

    Disclaimer - I'm not a lawyer. Consult one for proper advise...

    What I think you are talking about is a Model Release - allows the photographer to do with the resulting photos whatever is stated in the release. I might suggest you google for "Model Release" and see what you get.

    If you have no (or little) business insurance, you might want to look into some sort of liability waiver for the model(s) to sign. This may (or may not) release you from liability claims should something unfortunate happen.

    first of all what you're looking for are model "releases" and if you ever intend to sell, or lend, your images to a third party for commercial use you'd better damn well have releases. thumb.gif

    And-- just want to add that most model releases do NOT agree to share rights to your images with the model. While it's common to give permission to the model to use the images for a portfolio or self-promotion, the "rights" to the photo generally remain with the photographer. In other words, a model usually can't sell your images without your permission.

    As I'm sure you're realizing, it's important to understand the difference and be careful with the language you use in releases or usage agreements. What you don't want to happen is for a model to think they can sell your images to a publication, agency, etc without first making sure you agree to that. Just because someone lets you capture their image doesn't mean they can do whatever they want with the photo.
