I've personally seen this guy be warned about being uncivil three times. I'm told that the total is much more than that. Yet you still let him be uncivil.

Okay, then in the generic - how many warnings before you ban someone? Can a member simply be uncivil as often as s/he wants, taking a warning each time with impunity?
Or, if you wish me to only concern myself with myself, how many times can I be uncivil before action other than a warning?

I'm going to step in and here, and (keeping in mind that I'm not giving you an official stance, just speaking as one of the moderators here) say this:
While we all think we do a pretty good job of running an amiable, helpful and informative board, we are always looking for feedback. Thanks, Cambler for yours.
What I would like to know from you is, are you happy overall with the way we moderate? Can you understand that it's not really possible to put a quota on violations of our standards to determine when to ban a member? Can you trust us to take your input as well as the input of the rest of the members and, putting the interests of the community first, make appropriate decisions about how to handle uncivil or offensive posts?

With the singular exception of this one individual, yes.
In the case of this one individual, I believe that the line was crossed months ago, and the lack of action to date is clear and unfortunate.
That's my opinion, of course, and is worth exactly what you paid for it. And I also hasten to point out that this site is free, and I don't presume that my SmugMug fee entitles me to anything here, and I appreciate the board and the opportunity to bring the issue up and have it seriously considered.

You may wanna consider an Image Verification page in the sign up process, we had this problem on another forum I frequent and it has helped alot. Ya know the broken up image thing where people have to type in the alpha numeric combo to sign up.
