If you have not registered your images with the US copyright office, it is almost impossible to get punitive damages. The best you could hope for would be actual damages. If you had a published or easily discoverable price list that included nationwide or worldwide publication you could hope to collect that amount.
You could always send the publisher a demand letter. They may pay, you never know.
I saw my night image I embedded many pages ago on our local TV, just to keep this somewhat on topic. I am waiting for them to pay me in big bags of gold. I might have to wait for a while.

"A photo is like a hamburger. You can get one from McDonalds for $1, one from Chili's for $5, or one from Ruth's Chris for $15. You usually get what you pay for, but don't expect a Ruth's Chris burger at a McDonalds price, if you want that, go cook it yourself." - me
I’m sorry to be the bearer of bad news. I learned that Sid passed suddenly this past weekend.
I first met WxWax while he was traveling here in the Bay Area. He was also an avid motorcyclist and very active on adventure rider where he’d recently begun writing for the front page part of the site. He was a big soccer fan and had covered his favorite club, Chelsea FC, for SB Nation. During his career, he worked for various television stations in addition to writing, directing and producing documentary films.
We’ll miss you Sid. Godspeed and condolences to your family and many friends.

In honor of the move to the new forum, it's only fitting that Sid gets a bump!

Well played, Moose!
So... how is Sid doing?
Welcome back! I'm sure Sid is off somewhere, enjoying the windfall in royalties he received.
